A small estate affidavit covers personal property only, never real estate, and requires a 45-day wait. Creditors have three months, and unsupervised administration is common, though disputes and missing paperwork can still cause delays.

Personal Injury in Indiana

Indiana gives two years for most injury claims, but only 180 days to notify a government entity. Recovery is barred only when your fault exceeds 50%, so a 50-50 split still pays. Ordinary injury claims face no damage cap, but medical malpractice caps total recovery, not just noneconomic damages. Attorney fees are not capped in general personal injury cases, and malpractice cases use a split-fee structure.

Family Law in Indiana

Indiana pools all property of both spouses and presumes that an equal division is just and reasonable. Child support uses a weekly schedule and worksheet built on income shares, add-ons and a parenting time credit based on overnights. Maintenance is allowed only for incapacity, for caring for an incapacitated child or for rehabilitation. A divorce requires six months of state residence and three months in the county, then 60 days after filing.
