Three statutes, not one
The General Wrongful Death Act (Ind. Code §34-23-1-1) covers adults with a surviving spouse or dependents — no cap. The Adult Wrongful Death Act covers unmarried adults with no dependents — noneconomic damages like loss of love and companionship are capped at $300,000, and a parent or adult child claiming that loss must prove a "genuine, substantial, and ongoing relationship" with the deceased. The Child Wrongful Death Act (Ind. Code §34-23-2-1) covers unmarried minors under 20, or students under 23 — no cap.
Even a partial financial dependent generally moves a claim out of the capped category and into the uncapped General Wrongful Death Act. Filing rights also differ: for any adult, only the estate's personal representative can file; for a child, parents or a legal guardian can file directly.
