Malpractice deaths
The same noneconomic cap applies: $712,847 as of January 1, 2026, unless the exception for permanent injury or death and reckless conduct applies.
Punitive damages
Punitive damages are capped at the greater of three times compensatory damages or $250,000.
Broad compensatory categories
Compensatory damages under N.C.G.S. 28A-18-2 include the decedent's pain and suffering and the loss of society, companionship, comfort, guidance, kindly offices and advice.
How other states compare
New Jersey and New York limit wrongful death recovery to pecuniary loss, while North Carolina allows companionship damages without a cap outside malpractice. Its pure contributory negligence rule is the larger hurdle.
