Companionship and guidance are recoverable

N.C.G.S. 28A-18-2 lists the recoverable damages, including the decedent's pain and suffering, funeral expenses and the present monetary value of the decedent to the persons entitled to recover, which covers lost net income, services, protection, care and assistance, and society, companionship, comfort, guidance, kindly offices and advice.

There is no specific cap on wrongful death damages, but the malpractice noneconomic cap and the punitive cap still apply. The family's biggest risk is pure contributory negligence. The deadline is two years from the death.
