Wrongful Death Deadline vs. Personal Injury Statute of Limitations

Nevada's wrongful death deadline matches the general injury deadline, with a separate rule for deaths from malpractice.

Two years from death

A wrongful death claim must be brought within two years, running from the date of death, under NRS 11.190(4)(e), and the action is maintained by the heirs and the personal representative under NRS 41.085.

Compared with an injury claim

Most personal injury claims also have two years, measured from the injury. So the family's period matches what the injured person would have had.

Medical malpractice

The deadline in NRS 41A.097 covers injury to or the wrongful death of a person: three years from the injury or one year from discovery. Do not assume the two-year death deadline governs a malpractice death.

Government defendants

Claims against the State or local governments follow special rules in NRS 41.031 to 41.039, including notice requirements, so confirm early which procedures apply.
