Two actions that can be joined

NRS 41.085 lets both the heirs and the personal representative maintain an action, and the two may be joined. The heirs can recover pecuniary damages for grief or sorrow, loss of probable support, companionship, society, comfort and consortium, and for the decedent's pain, suffering or disfigurement. The personal representative recovers special damages and any punitive damages the decedent could have recovered.

Nevada courts read the statute's list of recoverable damages strictly. There is no cap outside professional negligence, where the NRS 41A.035 limit applies. The deadline is two years from the date of death.
