Wrongful Death Deadline vs. Personal Injury Statute of Limitations

Idaho keeps its wrongful death and personal injury deadlines aligned at the same length — but a medical malpractice wrongful death claim carries a separate procedural trap worth knowing about.

The same general period

Idaho's wrongful death deadline is 2 years from the date of death, under Idaho Code §5-219(4) — the same general period Idaho uses for an ordinary personal injury claim. Unlike some states that set a meaningfully different deadline for wrongful death specifically, Idaho keeps the two aligned.

A separate risk for malpractice deaths

If the wrongful death resulted from medical malpractice, missing a required prelitigation notice or screening step can bar the claim entirely — separate from, and in addition to, the standard 2-year statute of limitations. This is a procedural trap that doesn't exist for an ordinary (non-medical) wrongful death claim, and it can cut off a claim well before the limitations period itself would.

The clock starts at death, not the original injury

The wrongful death deadline runs from the date of death, not from any underlying injury. This matters when someone is injured, survives for a period, and later dies from that injury: the 2-year wrongful death clock starts fresh at death, giving the family their own window from that point forward.
