Heirs can sue directly, not just through the estate
Under Idaho Code §5-311, the decedent's heirs may maintain the wrongful death action themselves, or the personal representative may bring it on their behalf — a genuine either/or structure, unlike states that require the estate to act exclusively. "Heirs" follows Idaho's intestate succession rules.
Damages are measured by a flexible standard — "as under all the circumstances of the case as may be just" — rather than a fixed formula. The same wage-indexed noneconomic damages cap from Idaho Code §6-1603 that applies to ordinary injury claims applies here too; economic damages like lost support remain uncapped.
