Child Support Past 18 in Utah: High School Graduation and Age Limits
In Utah, child support runs to the later of the 18th birthday and graduation in the child’s normal and expected year of graduation. The state presumes May unless a specific date is documented.
What is the child support age limit in Utah?
A child is emancipated when the child becomes 18 or graduates from high school during the child’s normal and expected year of graduation, whichever is later (Utah Code 81-6-213(1)(a)). A “child” includes a son or daughter 18 or older while enrolled in high school during the normal and expected year of graduation (81-6-101(7)(b)).
What is the Utah normal and expected year of graduation?
For a child attending school in Utah it is kindergarten plus 12 years of school, unless a deviation was known when the order was entered, the child was held back or advanced before the order, or the child later gets an early diploma or equivalency (Utah Admin. Code R527-250-2). The agency presumes the month is May unless parents document a specific date (R527-250-3).
| Child born (graduating in May of the year they turn 18) | Turns 18 | Support can run to |
|---|---|---|
| March 15, 2012 | March 15, 2030 | May 31, 2030 |
| August 31, 2011 | August 31, 2029 | August 31, 2029 |
| November 2, 2015 | November 2, 2033 | November 2, 2033 |

What if a Utah child is held back later?
If a deviation to the kindergarten plus 12 standard is not known until after the order, the expected year is not changed unless the child receives an early diploma, an equivalency diploma or documentation of early completion of course requirements (R527-250-2(4)). A student held back after the order does not extend support.
What is the age of majority in Utah?
A child reaches the age of majority when the child turns 18 or is legally married (Utah Admin. Code R527-250-8, quoted in CS 812P), which is different from the emancipation date for support when the child is still in high school.
Who asks the school for the graduation date?
The agency sends the custodial parent an emancipation high school verification letter asking for the expected graduation date (CS 417P). Reply early so the date is set before the 18th birthday.
What if a Utah child graduates early?
The agency stops collecting the month after the child is 18 and no longer enrolled if the child receives a diploma on early graduation, provides documentation of early completion, or receives an equivalency diploma (R527-250-4, as quoted in ORS policy CS 417P).
What if a Utah child drops out?
The agency continues to collect until May of the normal year of graduation if a parent says the 18-year-old stopped attending, because the child may resume and graduate on time; a parent who disagrees can go to court (CS 417P).
What if the child is working toward a GED?
An 18-year-old working toward a GED instead of attending high school is not considered emancipated until receiving the equivalency diploma or until May with the normal graduating class, whichever comes first (CS 417P).
Is there Utah support to 21?
The period of minority extends to 18, but courts in divorce actions may order support to age 21 (Utah Code 15-2-1). Read your decree.
Do arrears end when child support ends?
No. Unpaid support remains enforceable for four years after the youngest child reaches majority, or eight years from a sum certain judgment, whichever is longer (78B-5-202(6)). See the Utah child support arrears calculator and how long arrears last.
