How Child Support Ends in Utah: Emancipation, Termination Orders and What to File

Utah emancipates a child at the later of 18 and graduation in the normal and expected year, or on death, marriage or armed forces service. Orders with several children adjust automatically only if they follow the guidelines.

Does child support end automatically in Utah?

The statute defines emancipation (Utah Code 81-6-213(1)) and, for orders with several children, adjusts the base award automatically to the remaining children when a child is emancipated, using the table and incomes from the most recent order, unless the order says otherwise (81-6-213(2)-(4)). If the incomes are missing or inconsistent, or the order deviates, the award is not adjusted automatically and the order continues until modified (81-6-213(5)).

What events end child support in Utah?

EventWhat happens
Child reaches 18 (and normal graduation year has passed)Emancipated
Child graduates in the normal and expected yearEmancipated on the later date
Child dies, marries or joins the armed forcesEmancipated
Court emancipates the child, or parental rights are terminatedEmancipated or the duty ends
Order has several childrenThe base award adjusts automatically to the remaining children, if the order allows
Order deviated from the guidelinesNo automatic adjustment; the order continues until modified

Does the amount drop per child automatically?

Not by a flat share. The base award may not be reduced by a per-child amount derived from the award originally ordered; it is recalculated from the table for the remaining children (81-6-213(4)).

What if my order deviated and the child emancipated?

If the parties later obtain an order adjusting support back to the emancipation date, the agency may not be required to repay the difference collected in the meantime (81-6-213(6)). File to modify promptly.

What do you file to end an order?

A petition or motion with proof of the event, or a request to the Office of Recovery Services if it enforces your case. See how to modify child support in Utah.

Do arrears stay owed after support ends?

Yes, for the duration period (Utah Code 78B-5-202(6)). Check the balance in the Utah arrears calculator and the date in the Utah child support end date calculator.

What counts as a deviated order for the automatic adjustment?

An order with a written finding that it deviates, a worksheet box checked for a deviation, or an order amount that differs from the worksheet by $10 or more; the incomes on the worksheet may not be used to adjust it for emancipation (Utah Code 81-6-202, quoted in CS 417P).

Where do I send proof of the event?

To the Office of Recovery Services if it enforces your case, to the court and to the other parent, with a copy of the death certificate, marriage record or enlistment papers (R527-250).

What if the child is in state care?

The agency says factual emancipation does not apply to children in juvenile justice, foster care and other state-care programs, and enforces support for them as unemancipated children (CS 417P).

Can a child be emancipated by court order?

Yes, under the emancipation title of the Utah Code, or by operation of law; factual emancipation requires a court order declaring it (81-6-213(1)(c); CS 417P).

What mistakes cause problems when support ends?

  • Stopping payments on an event without proof or a court order.
  • Assuming a deviated order adjusts itself.
  • Missing that graduation in the normal and expected year can extend support past 18.
  • Forgetting that past-due support is still owed.
