Ending, Modifying and Reinstating Oregon Spousal Support
Oregon spousal support ends on the death of either party, can be modified on a substantial change in economic circumstances (compensatory support only on an unanticipated loss of earning capacity) and, once terminated, can be reinstated within time limits.
Termination at death
Except for the unpaid balance of previously ordered support, liability for spousal support terminates on the death of either party, and there is no liability for support or for a substitute payment in cash or property after the death of either party (ORS 107.105(1)(d)).
Modification
The court may at any time modify the support of a party on motion. A substantial change in economic circumstances of a party, which may include a substantial change in the cost of reasonable and necessary expenses, is sufficient for the court to reconsider, except that compensatory spousal support may be modified only on an involuntary, extraordinary and unanticipated change in circumstances that reduces the paying spouse’s earning capacity (ORS 107.135).
Support tied to an age
If the judgment provided for a termination or reduction of support at a designated age in anticipation of pension or Social Security, the court considers that expectation when a party asks to reconsider.
Reinstatement
When a court has terminated spousal support, it may reinstate the remaining duration and amount if the moving party proves that the basis for the termination has ceased to exist and reinstatement is just and equitable. The motion must be brought within the remaining duration or within 10 years after the judgment terminating the award, whichever is sooner, and the parties may waive reinstatement in a signed writing that references the statute (ORS 107.136).
