Wrongful Death Damages: Sorrow, Solace and the Caps in Virginia
Virginia is generous on categories and caps only malpractice deaths and punitive damages.
What is listed
Va. Code 8.01-52 lets the jury or court award such damages as seem fair and just, including sorrow, mental anguish and solace, which may include society, companionship, comfort, guidance, kindly offices and advice of the decedent.
Economic damages
It also lists compensation for reasonably expected loss of the decedent's income and of services, protection, care and assistance, with expert testimony admissible; expenses for care, treatment and hospitalization; and reasonable funeral expenses.
Punitive damages
They may be recovered for willful or wanton conduct, or such recklessness as evinces a conscious disregard for the safety of others, up to $350,000 in total.
The malpractice cap
A death caused by malpractice is subject to the total recovery cap in 8.01-581.15, $2.75 million for acts from July 1, 2026 to June 30, 2027.
Fault
Pure contributory negligence can bar a claim if the decedent's own negligence was a proximate cause, subject to exceptions such as last clear chance.
