Consortium and grief are recoverable
Rhode Island's wrongful death statute lets a surviving spouse recover for loss of consortium and for emotional distress, grief and loss of enjoyment of life, and allows additional damages for loss of society and companionship to the spouse, children and parents.
The current text of section 10-7-1.2 also covers children and parents. Pure comparative negligence applies, and the deadline is three years.
