Grief and companionship are recoverable, and protected from caps
Under 12 O.S. 1053, damages include grief and loss of companionship, financial support and services, medical and funeral expenses, and the decedent's conscious pain and suffering. The statute's noneconomic damages are not subject to a ceiling.
The 2025 cap does not apply to wrongful death actions, which the Oklahoma Constitution protects from statutory limits. The deadline is two years from the death.
