Society and mental anguish are recoverable, with no cap
Ohio's wrongful death statute, R.C. 2125.02, expressly permits damages for mental anguish, companionship and loss of society, along with loss of support, services and prospective inheritance.
There is no cap at all in wrongful death claims: the statute exempts them and the Ohio Constitution protects them. The deadline is two years from the death.
