What the statute allows

RSMo 537.090 lets the jury award what it deems fair and just for the death and the loss, including pecuniary losses, funeral expenses, and the value of lost services, consortium, companionship, comfort, instruction, guidance, counsel, training and support. The jury may also award what the deceased suffered between injury and death, and may consider mitigating or aggravating circumstances. Damages for grief and bereavement are expressly not recoverable.

Only one action may be brought for a death, by the classes of relatives listed in RSMo 537.080. There is no cap outside health care malpractice, where RSMo 538.210 limits noneconomic damages and treats every wrongful death claimant as one plaintiff.
