Wrongful Death Deadline vs. Personal Injury Statute of Limitations
Iowa's two deadlines line up closely — a direct consequence of treating the wrongful death claim as the decedent's own, simply continued by the estate.
The same general period
Iowa's wrongful death deadline is generally 2 years from the date of death, under Iowa Code §614.1(2) — the same general period that governs an ordinary personal injury claim under §614.1.
Why the alignment isn't a coincidence
Because Iowa's wrongful death claim is legally the decedent's own cause of action, continued after death under the survival statute (Iowa Code §611.20), it doesn't carry a separately-calculated deadline the way an independently-created statutory wrongful death action might in other states.
The clock starts at death
For the wrongful death claim itself, the deadline runs from the date of death, not from any underlying injury. This matters when someone is injured, survives for a period, and later dies from that injury: the estate gets its own 2-year window starting at death.
A different deadline for malpractice-related deaths
A wrongful death claim rooted in medical malpractice follows Iowa's medical malpractice statute of limitations under Iowa Code §614.1(9) instead, which can differ from the general personal injury deadline.
