Beneficiaries broader than the usual hierarchy
Under HRS §663-3, eligible claimants include the surviving spouse, reciprocal beneficiary, children, father, mother, and any person wholly or partly dependent on the deceased — a notably broader group than the strict spouse-children-parents chain many states use. Damages are allocated to each beneficiary based on what they individually proved, not by a fixed statutory share.
Core relational damages — loss of society, companionship, comfort, consortium, protection — are not treated as "pain and suffering" for cap purposes, so they escape Hawaii's $375,000 cap entirely. Only if actual pain and suffering is separately claimed does the cap come into play.
