Uncapped, with one narrow exception
Under 10 Del. C. §3724, damages may be awarded to the beneficiaries — primarily the spouse, children, and parents — proportioned to their actual injury from the death. There's no overall dollar cap on the claim, covering deprivation of pecuniary benefits and mental anguish to the surviving spouse and next-of-kin. The one specific limit: reasonable funeral expenses are capped at $7,000 (or the amount designated in Title 29 §5546(a), whichever is greater).
