How this Colorado estimate works

Under C.R.S. §13-21-203, as amended by HB 24-1472, Colorado's wrongful death cap is $2,125,000 for claims filed in 2025 or later. There is no cap at all if the wrongful act constituted a felonious killing as defined under Colorado statute. Medical malpractice wrongful death follows its own lower schedule: $810,000 in 2026, rising to $1,575,000 by 2029.

HB 24-1472 also expanded who can bring the claim — a sibling of the deceased may now file in certain circumstances, beyond the traditional spouse, children, and parent categories.
