Arkansas Wrongful Death Damages Calculator

Arkansas's constitution bans capping damages for death the same way it bans capping ordinary injury damages. The real limit is fault: reach 50% responsibility and the claim is barred entirely, no matter how clear the underlying liability.

How this Arkansas estimate works

Under Ark. Code §16-62-102, recoverable wrongful death damages are defined broadly: pecuniary injuries, loss of companionship, and mental anguish. Under Arkansas Constitution Article 5, §32, neither the economic nor the noneconomic portion is capped.

Arkansas distinguishes the family's wrongful death claim from the estate's separate survival action, which covers different claims the decedent personally held at death. This calculator estimates the wrongful death claim — the beneficiaries' own loss — not a survival claim.
