Does Vermont allow UM/UIM stacking?

The statute we read does not say. It requires UM, UIM and hit-and-run coverage in every auto liability policy and defines an underinsured vehicle by comparing the other driver's liability limits with your UM limits (23 V.S.A. 941(a) and (f)). A vehicle is underinsured to the extent the liability limits applicable at the crash are less than your UM limits, or available limits were reduced by payments to others hurt in the crash to less than those limits (23 V.S.A. 941(f)). We read that as the difference between the limits.

What if I was partly at fault?

Accepted Answer

You can still recover if your negligence is not greater than the defendants' causal total, and your damages are reduced in proportion, so 50 percent is allowed and more is not (12 V.S.A. 1036).

How long do I have to sue?

Accepted Answer

Three years for injuries to the person (12 V.S.A. 512(4)). A person who is a minor when the claim accrues may sue within that time after the disability is removed (12 V.S.A. 551).
