Wyoming Pain & Suffering Calculator

Wyoming's Constitution prohibits any law limiting damages for injury or death, so there is no cap on pain and suffering against private defendants, even in malpractice. You recover if your fault is not more than 50%, and each defendant pays only its share. Governmental entities have statutory limits.

The Constitution forbids caps

Article 10, section 4(a) of the Wyoming Constitution bars any law limiting the amount of damages recovered for injury or death. Fault is governed by W.S. 1-1-109, which allows recovery at 50% or less and makes each defendant liable only for its share.

Claims against governmental entities follow the same Title 1 statutes: W.S. 1-39-118 limits recovery, and the general deadline is four years under W.S. 1-3-105.
