No cap for survivors, after Busch
The Oregon Supreme Court in Busch v. McInnis Waste Systems (July 9, 2020) held that the $500,000 cap in ORS 31.710(1) was unconstitutional under Article I, section 10 as applied to personal injury claims. The jury in that case had awarded $10.5 million in noneconomic damages to a pedestrian who lost a leg.
Fault follows ORS 31.600, and liability is several only under ORS 31.610. Public bodies have separate Tort Claims Act limits.
