The cap came back in 2025

The Oklahoma Supreme Court struck down the old $350,000 cap in 2019, but Governor Stitt signed Senate Bill 453 in May 2025, reinstating a $500,000 cap for injuries on or after September 1, 2025. The law, 23 O.S. 61.3, has exceptions for permanent and severe physical injury and for heightened misconduct, and a $1 million cap for permanent mental injury.

Fault follows 23 O.S. 13, which bars recovery only when your negligence is of greater degree than the combined negligence of the persons causing the damage.
