A malpractice cap that climbs to $750,000

Nevada has no cap on pain and suffering in ordinary injury cases. For professional negligence against a health care provider, NRS 41A.035 limits noneconomic damages to $350,000, increased by $80,000 on each January 1 from 2024 through 2028, when it reaches $750,000, and then by 2.1% a year. The published 2026 amount is $590,000, and the Nevada Supreme Court posts the amounts annually.

Fault follows NRS 41.141: you recover if your negligence is not greater than the negligence of the defendants, and each negligence defendant is severally liable only for its own share. Punitive damages are limited under NRS 42.005.
