Missouri does not cap noneconomic damages across the board. The exception is RSMo 538.210: against a health care provider, no plaintiff may recover more than $400,000 in noneconomic damages ($700,000 for a catastrophic injury) regardless of the number of defendants, and both figures rise 1.7% each year. For 2026 that is about $481,494 and $842,614. Economic damages are not capped.

Fault is pure comparative under RSMo 537.765, so your own fault only reduces the award. Under RSMo 537.067, a defendant at 51% fault or more is jointly and severally liable for the whole judgment, while a defendant under 51% pays only its own share. Claims against public entities are limited by RSMo 537.610.
