A dramatically higher cap, starting in 2025

Under House Bill 24-1472, Colorado's noneconomic damages cap for an ordinary (non-malpractice) injury claim rose to $1,500,000 for cases filed on or after January 1, 2025 — up from $250,000 under the original 1986 statute (which had crept up to $642,180 through biennial inflation adjustments by 2024). Starting January 1, 2028, the new $1.5 million figure itself begins adjusting for inflation every 2 years.

Medical malpractice follows a separate, lower schedule: the old $300,000 cap is rising incrementally to $875,000 by 2029, reaching $530,000 in 2026.
