Retirement Benefits and Short Marriages in Utah Divorce
Utah divides the part of a retirement plan earned during the marriage, applies the Woodward formula to pensions when the parties cannot agree, requires a QDRO to divide accounts and may return the parties to their premarital positions after a short marriage.
Retirement and pension plans
Anything paid into a retirement or pension plan from the date of the marriage to the date of the divorce is divided equitably. If both spouses have benefits the court usually awards each their own; it is generally best for the contributing spouse to keep the plan and the other to receive something of equal value, such as home equity or cash (Utah Courts, property division).
Defined benefit plans: the Woodward formula
For pensions, if the parties cannot agree, the judge applies the Woodward formula: one-half of the value, times the years of marriage, divided by the years the employee has worked. For example, with a $30,000 account, 7 years of marriage and 12 years worked: $30,000 × 1/2 × 7 ÷ 12 = $8,750.
Defined contribution plans
For 401(k), 403(b), ESOP and profit-sharing plans there is no clear formula if the parties disagree; the court considers each party’s contributions during the marriage and circumstances at the time of the divorce. It may also weigh the date of separation or unreasonable conduct such as spending or giving away marital property.
QDROs
A qualified domestic relations order, signed by the judge after the decree, is needed before the plan administrator can divide an account or pay benefits to a spouse who did not contribute.
Short marriages
For short marriages the court may put the parties back into the economic position they had before the marriage: each gets what was theirs at the start.
