Missouri Property Division: Just Proportions
Missouri is an equitable distribution state: the court sets apart each spouse’s nonmarital property and divides the marital property and debts in proportions it deems just after five statutory factors, in a final order that cannot be modified.
Equitable, not community property
The IRS describes the nine community property states in Publication 555: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. Missouri is not one of them. In a dissolution the court “shall set apart to each spouse such spouse’s nonmarital property and shall divide the marital property and marital debts in such proportions as the court deems just” (RSMo 452.330.1).
Debts too
The court divides marital debts as well as marital property, in the same just proportions.
No fixed percentage
The statute does not say equal; it says proportions the court deems just after the five factors. In many marriages the result is close to equal, but conduct, the children’s needs and the value of each spouse’s nonmarital property can move it.
A final order
The court’s order dividing the marital property is final and not subject to modification, except that orders intended to be qualified domestic relations orders for pension, profit-sharing and stock bonus plans can be changed to keep them qualified or to carry out their intent.
Recording the decree
A certified copy of a decree affecting title to real estate may be recorded by the clerk with the recorder of deeds of the county where the property is.
