How a Pension’s Marital Share Is Calculated: The Coverture Fraction in Delaware

Delaware divides marital property equitably, in such proportions as the court deems just, and sets no formula or percentage for a pension. The time-rule fraction only illustrates the marital part.

What does Delaware say about dividing a pension?

Delaware divides marital property, and retirement earned during the marriage is part of it. In a divorce the court shall, on request of either party, equitably divide, distribute and assign the marital property between the parties without regard to marital misconduct, in such proportions as it deems just after considering all relevant factors (13 Del. C. 1513(a)). The statute does not name pensions or set a formula or a percentage.

Which factors guide the division in Delaware?

The length of the marriage; any prior marriage of a party; each party’s age, health, station, amount and sources of income, vocational skills, employability, estate, liabilities and needs; whether the property award is in lieu of or in addition to alimony; each party’s opportunity for future acquisitions of capital assets and income; the contribution or dissipation of each party in acquiring, preserving, depreciating or appreciating the marital property, including as a homemaker; the value of the property set apart to each party; each party’s economic circumstances when the division takes effect, including the family home; whether the property was acquired by gift; the parties’ debts; and tax consequences (1513(a)(1)-(11)).

What is marital property in Delaware?

All property acquired by either party after the marriage, except property acquired by bequest, devise, descent or gift that is titled and held in the donee spouse’s sole name or in a trust for that spouse, property acquired in exchange for premarital property, property excluded by valid agreement, and the increase in value of property acquired before the marriage. Jointly titled real property acquired before the marriage is also marital unless excluded by agreement (1513(b)). The calculator therefore shows the part outside the marital fraction separately.

What is a coverture fraction in Delaware?

It is a common way to find the marital part of a defined-benefit pension: months of service earned during the marriage divided by total months of service, applied to the benefit. Delaware’s statute does not prescribe it; we use it for illustration only, and the share is your own assumption in the Delaware pension division calculator.

How does the calculation work in a worked example in Delaware?

As an example, suppose a pension of $3,000 a month with 300 months of service, of which 180 months were during the marriage. The marital fraction is 60%, so the marital part is $1,800 a month. At a 50% share, the other spouse’s illustrative share is $900 a month and the plan holder keeps $2,100.

Example figureValue
Service during the marriage180 months
Total service300 months
Marital fraction60%
Marital part of the benefit$1,800
Illustrative share at 50%$900
Plan holder keeps$2,100

This is a labeled example, not a prediction; a court may pick a different share or method.

How is a pension actually paid to the other spouse in Delaware?

Through a domestic relations order that the plan accepts. A qualified domestic relations order creates or recognizes an alternate payee’s right to receive all or part of a participant’s benefits and must meet federal requirements (26 U.S.C. 414(p); 29 U.S.C. 1056(d)(3)). Government plans have their own order rules, so ask the plan before the decree is drafted.

What if the court does not divide it in Delaware?

The court acts on request, so ask for the retirement accounts to be divided and name each one. See the Delaware property division calculator for the rest of the estate.
