How Child Support Ends in Oregon: Emancipation, Termination Orders and What to File

Does child support end automatically in Oregon?
The statute defines when a child qualifies as a child attending school (ORS 107.108) and lets the court suspend or terminate support when circumstances change (107.135(1)(c)-(d)), but the sections we read describe no step that stops income withholding by itself. Who asks the court to end it?
Either party can move under 107.135 after service of notice; to suspend support for a child who ceased to attend school, the court first serves notice on the child as it would a summons (107.135(1)(d)). If the state holds support rights, serve it too (107.135(9)).

How does withholding work after support ends?
Orders must include income withholding, and withholding also starts when the obligor fails to pay at least one month of support (ORS 25.378). The sections we read do not describe a step that ends it automatically at 18 or 21, so ask in writing and send the employer a copy of any order.
Can I recover attorney fees?
In a proceeding to modify, the court may assess a reasonable attorney fee and costs against either party; if a party acted in bad faith, the court shall order that party to pay the defending party’s fees (107.135(8)).
