How Child Support Ends in Ohio: Emancipation, Termination Orders and What to File
Ohio child support does not end by itself in practice. The custodian must notify the agency of a listed reason, such as marriage, emancipation or enlistment, and arrears can still be enforced after termination.
Does child support end automatically in Ohio?
Not by itself in practice. The residential parent or custodian must immediately notify the agency of any reason the order should terminate, and the obligor may notify it (ORC 3119.87). The agency or court then terminates the order for a listed reason (3119.88). Ask in writing for withholding to end.
What events end child support in Ohio?
| Event | What happens |
|---|---|
| Child reaches 18, no full-time school | The order should terminate |
| Child stops full-time high school after 18 | A listed reason to terminate |
| Marriage, emancipation, enlistment, adoption, death | Listed reasons to terminate |
| Change of legal custody | A listed reason to terminate |
| Arrears remain | The obligee can still enforce them |
| Past-due support | Stays owed |
The full list also includes the child’s death or deportation, the obligor’s death, a grandparent’s report that the order should end, and the obligor’s marriage to the obligee if they live together with the child (3119.88(A)).
What does the agency investigate?
Within 20 days of a notice, if services are on file, the agency determines whether a reason exists, whether other children are subject to the order, whether arrears are owed, whether withholding should continue for them or for arrears, and whether payments should be impounded to avoid an overpayment (3119.89).
What if the order says something different?
A court order may set its own termination condition, for example for a child who reaches 19 (3119.88(A)(3)). Read your order.
What do you file to end an order?
A written notice to the agency with proof of the event, or a motion to the court. See how to modify child support in Ohio.
Do arrears stay owed after support ends?
Yes. If the obligor owes arrears after termination, the obligee can apply to the agency to enforce them, and withholding to collect them is presumed to be at least the prior amount (3123.14). Check the balance in the Ohio arrears calculator and the date in the Ohio child support end date calculator.
What does the agency do with overpaid support?
During its investigation it considers whether payments under the order should be impounded because continued receipt and disbursement would lead to an overpayment by the obligor (3119.89(A)(5)). Ask in writing so the agency looks at it.
Can the court end an order for other reasons?
A court may terminate an order for the listed reasons and others in the section; read the full list in the statute (3119.88(B)) and ask a licensed Ohio attorney how it applies to your order.
Who should be told when support ends?
Your county child support enforcement agency, the court if you have a court order, and your employer’s payroll office if it withholds. Send each a written request with the birth certificate and proof of the event, and keep proof of delivery.
What if support is overpaid after the end date?
The agency considers impounding payments to prevent an overpayment during its investigation (3119.89). Ask in writing for a credit and keep proof of every payment after the date.
What mistakes cause problems when support ends?
- Stopping payments without notifying the agency.
- Assuming withholding ends by itself.
- Missing that high school attendance after 18 extends support.
- Forgetting that past-due support is still owed.
