What if the order says something different?

The rule applies unless a court order, judgment or court-approved preexisting agreement provides otherwise. Orders entered after P.L.2015, c. 223 must include information about termination (56.67(d)). Read your order and any approved agreement.

What do you file to end an order?

Usually nothing at 19, because termination is automatic, but file a motion if an event such as marriage or military service happens and the order says otherwise, or if you disagree with a continuation: the paying parent may file a motion at any time (56.67(c)). What if there are several children?

The statute speaks of the child’s own termination; for an order that covers other children, the recurring support continues for them unless the court recalculates. Ask Probation how it will split the order, and file for recalculation.

Do arrears stay owed after support ends?

What if the order covers several children?

Ask Probation how it will treat the order when one child reaches 19, and file for a recalculation if the remaining children need a new amount. The statute ends the obligation for the child who ages out (2A:17-56.67).

Who tells the employer to stop withholding?

Probation sends the payor a notice when withholding must change or end, and the payor is bound by the withholding until further notice from Probation (2A:17-56.11). Ask Probation in writing so the employer gets the notice.

What if support is overpaid after the end date?

Ask the court or Probation in writing for a credit and keep proof of every payment after the date. The sections we read describe no automatic refund.
