How Child Support Ends in Minnesota: Emancipation, Termination Orders and What to File

A Minnesota per-child support order ends automatically on emancipation unless it says otherwise, but an order for several children without per-child amounts continues in full until the last child is emancipated. Withholding does not stop by itself, and past-due support stays owed.

Does child support end automatically in Minnesota?

A per-child order does: it terminates automatically and without any action by the obligor on the child’s emancipation, unless a court order provides otherwise (Minn. Stat. 518A.39, subd. 5(a)). But the sections we read describe no step that stops income withholding by itself. Ask the court or the county to end it and keep proof of the date.

What events end child support in Minnesota?

EventWhat happens
Child reaches 18Support ends unless the child is still in secondary school or cannot self-support
Child under 20 still in secondary schoolStill a child for support purposes
Per-child order, emancipationTerminates automatically unless the order says otherwise
Order for several children not per childContinues in full until the last child is emancipated
Income withholdingStays until the court or the county ends it
Past-due supportStays owed as judgments

What if the order covers several children?

An order that is not a specific amount per child continues in the full amount until the last child is emancipated or the court orders otherwise. The obligor may ask for a modification when a child is emancipated if minor children remain, using the incomes at the time of the motion (subd. 5(b)-(c)).

What do you file to end an order?

A motion to modify or terminate, with proof of the event, served on the other parent. A change reaches back only to service (subd. 2(f)), so file as soon as the event happens. See how to modify child support in Minnesota.

What if the paying parent dies?

Unless otherwise agreed in writing or provided in the order, support is not terminated by the death of the obligated parent; the amount may be modified, revoked or commuted to a lump sum to the extent just and appropriate (subd. 4).

Do arrears stay owed after support ends?

Yes. Each installment is a judgment and can be renewed until paid (548.091, subd. 3b). Check the balance in the Minnesota arrears calculator and the date in the Minnesota child support end date calculator.

Can Minnesota support be extended after an order ends at 18?

If the child is still attending secondary school and under 20, ask the court to confirm the order continues; if the child cannot self-support, ask for continued support at any age (518A.26, subd. 5). Do it before the order ends if you can.

Can I get a credit for overpayments after the end date?

Ask the court or the county in writing and keep proof of every payment after the child reached the end date. The sections we read describe no automatic refund.

Who should be told when support ends?

The court, your county child support office if it collects your payments and your employer’s payroll office if it withholds. Send each a written request with the birth certificate and proof of the event, and keep proof of delivery.

What mistakes cause problems when support ends?

  • Stopping payments on an event without asking the court.
  • Assuming the withholding ends by itself.
  • Missing that a child still in secondary school can still be covered.
  • Forgetting that past-due support is still owed.
