How Oklahoma Collects Unpaid Child Support: Wage Garnishment, License Suspension and Passport Denial

If you don’t pay child support in Oklahoma, each payment becomes a judgment that draws interest, wages can be withheld, and a court can revoke or suspend licenses when you miss the current month and the two before it.

What happens if you don’t pay child support in Oklahoma?

Each past-due payment is a judgment by operation of law (43 O.S. 137(A)), interest runs from the date it became delinquent (43 O.S. 114), and the court may determine the arrearage whenever a support order is entered, enforced or modified (112(G)).

How much can Oklahoma take from my paycheck?

Income withholding is the main tool, within federal limits: 50% or 60%, and 55% or 65% for support more than 12 weeks overdue (15 U.S.C. 1673(b)).

When can a court revoke or suspend a license?

A court can order the revocation, suspension, non-issuance, nonrenewal or probation of a license of an obligor who is out of compliance with a support order. Compliance means paying the current child support and the monthly arrearage payments for the current month and the two months before it, or paying an amount equal to three months of both (43 O.S. 139.1). Child Support Services follows these sections and sections 240.15 to 240.21 of title 56 in its enforcement actions.

Can I get a license back?

The obligor can move for reinstatement and must serve the motion on Child Support Services when it provides services; the court terminates the order if the obligor is in compliance, and the obligor sends the reinstatement order to the licensing board and the custodian (43 O.S. 139.1). Child Support Services also helps people obtain a provisional driver license where the lack of a license blocks employment.

Where is the license rule written?

In 43 O.S. 139.1 and the related sections the agency cites, 56 O.S. 237.1 and 240.15 to 240.21A (statute text). Read the notice you receive for your hearing date.

Can Child Support Services change the payment plan?

When licenses are placed on probation with a court payment plan, Child Support Services may ask the court to amend the plan on a change of circumstances (OAC 340:25-5-211.1). Tell the agency promptly if your income changes.

What about passports?

If a state agency certifies that a person owes child support arrearages of more than $2,500, federal law requires refusal of a passport (42 U.S.C. 652(k)). The Oklahoma arrears calculator warns when the unpaid principal passes that figure.

What other tools exist?

The agency’s remedies include tax refund interception, liens and bank matches, and the court can punish willful non-payment as contempt; we did not read the full list, so ask Child Support Services which apply to your case.

What should you do if you owe?

Respond to every notice, set up a payment plan before a hearing, add up the balance in the Oklahoma child support arrears calculator and, if your circumstances changed, file a motion to modify right away.
