How Long Child Support Arrears Last: Collection Limits, Back Support and Forgiveness in Idaho

Idaho child support arrears are not reduced by a later modification: only installments after the motion can change. We found no expiration date; the court can credit arrears after 120 days of primary residence with the paying parent.

Do child support arrears expire in Idaho?

The statutes we read set no expiration date for support arrears, and we are not stating one. Idaho law makes a support decree modifiable only as to installments accruing after the motion for modification (Idaho Code 32-709(1)), so past installments are not reduced by a later change. Ask a licensed Idaho attorney how any limitation or renewal rule applies to your debt.

Can a judge forgive child support arrears in Idaho?

Not by modifying past installments. The one statutory adjustment we found is a credit: the court may allow a credit against arrears for periods exceeding 120 days during which the minor children lived primarily with the obligated parent with the knowledge and consent of the custodial parent (32-709(2)). Otherwise the way to limit arrears is to file a motion to modify before installments fall due.

Can income withholding be ended?

An obligor can ask the court to quash, modify or terminate it, but relief needs a showing of a substantial probability of irreparable injury to the obligor and none to the obligee, and paying off a delinquency is not grounds. After 12 consecutive months of withholding with the obligation current, the court may terminate it on the obligor’s motion unless the other parent shows good cause (32-1215).

Does the lien ever end?

When a perfected lien’s underlying delinquency reaches a zero balance or is otherwise satisfied, the lien is automatically released, and a notice of release is filed (7-1206).

Can the department reduce what it collects?

Child Support Services can charge fees, including a $25 application fee, a $25 fee each time support is collected by tax offset and a $35 annual service fee when at least $550 is collected in the federal fiscal year (7-1203(7)). Those fees are separate from the support you owe, so ask for an itemized statement.

How do the credit and lien notices work?

Before the department reports to consumer reporting agencies it must give the parent notice, including the methods available to contest the accuracy of the information, and a perfected lien cannot be enforced until 10 days after the department notifies the obligor of the filing (7-1206(3)-(4)). Use those windows to dispute errors or arrange a payment plan.

Do arrears survive when the child turns 18?

Yes. The end of current support does not erase installments already owed. See the Idaho child support end date calculator.

What should you do about a large balance?

Get the official balance, compare it with the Idaho child support arrears calculator, ask Child Support Services about a payment plan, and if your circumstances changed, file a motion to modify right away.
