How Long Child Support Arrears Last: Collection Limits, Back Support and Forgiveness in Georgia
Georgia child support arrears are judgments by operation of law and cannot be modified retroactively. We found no expiration date, and a court can waive or reduce the interest but not erase the principal.
Do child support arrears expire in Georgia?
The statutes we read do not give an expiration date for support. They make each installment a judgment by operation of law with the full force and effect and attributes of a judgment of the state, entitled to full faith and credit and not subject to retroactive modification (O.C.G.A. 19-6-17(e)). Court rules on dormancy and renewal of judgments exist elsewhere in the Code; ask a licensed Georgia attorney how they apply to your debt.
| Question | Georgia rule |
|---|---|
| Each installment | A judgment by operation of law on and after its due date (19-6-17(e)) |
| Retroactive changes | Not allowed (19-6-17(e)(3)) |
| Interest | May be waived or reduced by the court (7-4-12.1) |
| Lien | Arises as of the due date; survives until released (19-11-18(b)) |
| Time limit to collect | We found none in the statutes we read; ask an attorney about renewal |
| Contempt | Hearing within 30 days of service of the motion (19-6-28) |
Can a judge forgive child support arrears in Georgia?
Not by modifying past installments: they are not subject to retroactive modification. The court can, however, waive or reduce the interest on them and can change the date interest starts, after weighing good cause for nonpayment, hardship and the parent’s current ability to pay (7-4-12.1). The way to limit arrears is to file and serve a petition to modify before installments fall due.
Does the lien ever end?
The lien arises as of the date each obligation was due and stays until released; the statute lists when it ends and requires the agency to send written notice of unpaid support at least once a year (19-11-18).
Can the agency stop collection for hardship?
Collection tools such as license suspension have hearing and payment-plan options: at the agency hearing, the issues include whether the obligor may pay past-due support in periodic payments and whether the obligor has been able and willing to comply (19-11-9.3(h)). These are about how and when you pay, not about erasing the debt.
How should you read a lien or arrears notice?
- Check the amount and the period it covers against your payment record.
- Check whether interest is included and from what date (30 days after each due date).
- Note any deadline for a hearing or to reach an agreement.
- Ask the agency for the payment history if you disagree (19-11-18).
How old is each installment? A table
Interest runs from 30 days after each due date, so the oldest installment carries the most:
| Age of a $500 installment | Interest on that installment so far |
|---|---|
| 1 months old | $0.00 |
| 2 months old | $2.92 |
| 6 months old | $14.58 |
| 12 months old | $32.08 |
| 24 months old | $67.08 |
| 36 months old | $102.08 |
Totals on a balance add these up installment by installment.
Do arrears survive when the child turns 18?
Yes. The duty to support a minor child ends at majority, marriage, emancipation or death, but installments that already became judgments stay owed. See the Georgia child support end date calculator.
What should you do about a large balance?
Get the official balance, compare it with the Georgia child support arrears calculator, ask the Division about a payment plan, ask the court to waive interest if you qualify, and if your circumstances changed, serve a petition to modify right away.
