Revising Alimony in Wyoming

Revising a decree

After a decree for alimony, the court may from time to time, on the petition of either party, revise and alter the decree respecting the amount of the alimony or allowance or the payment of it (Wyo. Stat. 20-2-116). Either the payer or the recipient can ask.

A change in circumstances

A petition should show what has changed since the decree, such as a change in either party’s income, health or needs; the statute does not list the grounds, so the petition should explain why the existing terms no longer fit.

Put termination events in the decree

Because the statutes do not spell out every ending event, the decree or settlement agreement should say expressly what happens on the recipient’s remarriage or cohabitation, the death of either party and retirement, and whether the alimony can be modified at all.

Alimony set by an agreement may be governed by that agreement’s terms, so a clause making it non-modifiable, or limiting its duration, matters; have an attorney review it before you sign.
