How Long Rhode Island Alimony Lasts

The purpose

“Alimony is designed to provide support for a spouse for a reasonable length of time to enable the recipient to become financially independent and self-sufficient” (R.I. Gen. Laws 15-5-16(c)(2)).

When it can be indefinite

However, the court may award alimony for an indefinite period when it is appropriate in the court’s discretion, based on the factors in subdivision (b)(2)(ii)(B): the time and expense required for the supported spouse to acquire the education or training to develop marketable skills and find appropriate employment.

No schedule of years

The statute gives no percentage of the marriage and no table of durations. The reasonable length depends on how long it will take the recipient to retrain and become self-sufficient, and on the other factors.

Counsel fees

The court may order counsel fees in addition to or in place of alimony.

Evidence to gather

Tax returns and pay records, a budget for each household, education and work history, a retraining plan with its cost and time and the standard of living during the marriage.
