Ending and Modifying Oklahoma Alimony
Oklahoma support alimony ends on the recipient’s death or remarriage, can be reduced or ended for continuing cohabitation, and can be modified on substantial and continuing changes, but only from the date the motion is filed.
Death and remarriage
The decree must provide that, on the death or remarriage of the recipient, support payments not already accrued terminate. On proof of death the judgment is terminated and the lien released unless an executor, administrator or heir claims past-due support within 90 days (43 O.S. 134(B)). On remarriage the court terminates support and discharges the lien on application, unless the recipient shows within 90 days of the remarriage that support is still needed and circumstances have not made it inequitable.
Cohabitation
The voluntary cohabitation of a former spouse with a member of the opposite sex is a ground to modify support. On proof of a substantial change of circumstances relating to need or ability to support, the court may reduce or terminate future payments. Cohabitation means dwelling together continuously and habitually in a private conjugal relationship not solemnized as a marriage (subsection C).
Modification
Support alimony may be modified on proof of changed circumstances relating to the need or ability to support that are substantial and continuing so as to make the terms of the decree unreasonable to either party. The modification may extend to the terms of payment and the total amount, but only prospectively (subsection D), and is effective from the date the motion was filed.
Property payments
Payments pertaining to a division of property continue until completed and cannot be modified.
