In New Mexico, rehabilitative, transitional and indefinite spousal support can be modified whenever circumstances render a change proper unless made nonmodifiable, and the court retains jurisdiction over periodic support after a marriage of 20 years or more.

Modifying support

The court may modify and change spousal support awarded as rehabilitative, transitional or indefinite support whenever the circumstances render the change proper; it may instead designate rehabilitative or transitional support as nonmodifiable as to amount or duration (NMSA 40-4-7(B)(2)). A lump sum in definite installments is not modifiable in this way.

The 20-year rule

The court shall retain jurisdiction over proceedings involving periodic spousal support when the parties have been married 20 years or more before the dissolution, unless the order or decree specifically provides that no spousal support shall be awarded (subsection F).

Indefinite support

Support for an indefinite duration has no end date, but it can be modified when circumstances change and ends on the receiving spouse’s death unless the order provides otherwise.

Transitional support

The period must be clearly stated in the final order, so the end date is known from the start.
