How Long Does Spousal Support Last in Hawai‘i?
In Hawai‘i, spousal support can be ordered for an indefinite period, until further order of the court, or for a specific duration based on the time needed to complete training and find appropriate employment; the statute sets no formula or maximum.
The three options
The statute lets the court order support and maintenance for an indefinite period or until further order of the court; if the court determines that support shall be ordered for a specific duration based on the time needed for the requesting spouse to secure training, education or skills, it orders support for a period sufficient to complete that activity and allows in addition sufficient time to secure appropriate employment (HRS 580-47(a); summarized by WomensLaw).
Indefinite
An indefinite order has no end date. It continues until a court changes it, and factor (13), the probable duration of the need, is the main evidence for it. Courts more often use it when the requesting spouse cannot realistically become self-supporting, because of age, health or a long absence from the workforce.
Until further order of the court
An order that runs until further order of the court has no fixed end and can be revisited at a later hearing. It is a middle path for cases in which the future is uncertain.
A specific duration
A specific term is tied to evidence: competent evidence of the time required to complete training, education or skills that will qualify the person for appropriate employment, including a new occupation or updated qualifications, plus time to find the job. See rehabilitative support.
No percentage of the marriage
Unlike states that cap support by a share of the marriage, Hawai‘i’s statute sets no formula or maximum. The duration of the marriage is a factor, not a limit.
Questions for the negotiation
Decide the amount, the length, the events that end it and whether it can be modified, because the statute leaves them to the order or agreement.
