The nine-month creditor window gets the attention, but the real bottleneck in New Jersey is usually a tax waiver — and you can't get one without filing and paying first.

New Jersey probate timeline — frequently asked questions

How long does probate take in New Jersey?

Most uncontested New Jersey estates take 9 to 18 months. The 9-month creditor claim period sets a real floor, but inheritance tax waivers — required before banks and brokerages release assets to most non-spouse beneficiaries — are the most common reason estates run past that floor.

How long do New Jersey creditors have to file a claim?

Nine months from the date of death, under N.J.S.A. 3B:22-4. Without a court-issued Order Limiting Creditors, this isn't an absolute cutoff — a creditor can still present a claim later against assets not yet distributed.

Why do New Jersey inheritance tax waivers slow probate down?

Banks, brokerages, and other institutions won't release estate assets to Class C or D beneficiaries — or transfer real estate — until a tax waiver is issued, and issuing one requires filing the inheritance tax return and paying the tax first. Each waiver commonly takes 6 to 8 weeks to process.

When can a New Jersey executor get Letters Testamentary?

Not before 10 full days after the date of death — the Surrogate's Court cannot issue Letters any earlier, even on a self-proving will.

Figures are based on New Jersey statute (N.J.S.A. 3B:22-4, 3B:22-7, 3B:22-10, 3B:22-16) and NJ Division of Taxation practice for inheritance tax waivers. Actual timelines depend on the specific county Surrogate's Court, whether the estate is contested, and how quickly waivers are processed.
