Talk to a Wyoming attorney

A real statutory percentage schedule, still in force

The attorney can be entitled to the same schedule — twice the cost

Wyo. Stat. §2-7-804 gives the estate's attorney an identical percentage schedule to the personal representative's, computed on the same probate-estate basis, so a Wyoming estate can face two full statutory fee awards rather than one.

Serving as both blocks double-dipping

If the same person serves as both personal representative and attorney, §2-7-805(c) bars the ordinary personal-representative fee entirely rather than allowing both to be collected.

No state income, estate, or inheritance tax

Wyoming imposes none of the three. See Capital Gains Tax on the Sale for why the gain itself owes nothing to the state.

Wyoming probate real estate sale — frequently asked questions

Does a Wyoming executor need court approval to sell the house?

Generally yes — Wyoming has not adopted the Uniform Probate Code, and even unsupervised probate is a court proceeding where a judge must approve actions like selling estate property.

How much does a Wyoming executor get paid for selling the house?

A statutory percentage: 10% on the first $1,000, 5% on the next $4,000, 3% on the next $15,000, and 2% on amounts over $20,000, under Wyo. Stat. §2-7-803.

Does the estate attorney get paid on the same schedule?

Yes — Wyo. Stat. §2-7-804 gives the estate's attorney an identical percentage schedule, computed on the same probate-estate basis, so a Wyoming estate can face two full statutory fee awards rather than one.

Does Wyoming have a state estate or inheritance tax on the sale?

No — Wyoming imposes neither, and it also has no state income tax at all, a genuine triple absence.

What is Wyoming's state tax rate on the sale's gain?

Zero — Wyoming has no state income tax of any kind, including on capital gains.

Holographic wills are valid here

Under §2-6-113, a will entirely in the testator's own handwriting and signed is valid without witnesses — for ranch families with longstanding written instructions this can matter, though holographic wills are easier to challenge and harder to probate than formally witnessed ones. Probate is filed in every Wyoming county's District Court.
